Terms of service
Effective from 2 September 2026 — last updated: 11 October 2026
These Terms of service (the «Terms») govern the use of themailamber.app website, the Mailamber account, theMailamber applications for Windows and for Android and the related subscription services. By creating an account you confirm that you have read and accepted these Terms and theprivacy policy.
1. Subject matter
Mailamber is an email client for Windows and Android built on a local-firstarchitecture: for all core functions (sync, reading, searching and organising mail), email contents, IMAP/SMTP credentials and access tokens stay exclusively on the user's device and do not pass through the Provider's systems. The Provider's online services are limited to account, license, payment and support management, synchronisation of settings across the user's devices (which can be turned off) and — in the plans that include it — theoptional artificial intelligence assistant: when the user freely chooses to invoke it, only the text they submit is transmitted to the Provider's systems and to the AI model providers listed in the privacy policy (section 10), which governs that processing. No AI feature is mandatory. The optional sent email tracking feature, where enabled, operates as described in the privacy policy, section 10-ter, and in section 10-bis of these Terms; settings synchronisation and the optional attachment reputation check operate as described in sections 10-quinquies and 10-quater of the same policy. Thanks to this architecture, the application keeps working for reading, searching and organising mail even when the Provider's online services are unavailable.
2. Who provides the service
The service is provided by (the «Provider»):
- Antonio Maraucci — sole proprietorship
- VAT number: IT09286091211
- Registered address: Via Raffaele Gasparri 16, 81100 Caserta (CE), Italy
- Email: support@mailamber.app
3. Account and requirements
- An account is required to use Mailamber and the paid plans, and is reserved to persons with the capacity to enter into contracts under the law applicable to them.
- You warrant that the data provided at registration is accurate and kept up to date, and you are responsible for keeping your credentials confidential and for the activity carried out through your account.
- The account is personal and non-transferable.
- The PC app requires 64-bit Windows 10 or Windows 11; the mobile app requires Android 7 or later and is distributed through Google Play. Both need at least one IMAP or PEC email account with a third-party provider, whose contractual relationship remains outside the Provider's control.
4. Plans, prices and devices
| Plan | Price | Devices |
|---|---|---|
| Free | Free of charge, with no time limit | 1 device — 1 email account |
| Plus | €2.99/month or €24/year | 2 devices |
| Premium | €5.99/month or €49/year | 5 devices (up to 15 with the Extra devices add-on) |
The features included in each plan are described on thepricing page. Prices are in euro and include VAT where applicable; the final price, including any VAT for the buyer's country, is shown at checkout before the order is confirmed. For buyers outside the EU, Paddle applies and remits any sales taxes due in the buyer's country and may display prices in local currency: the amount shown at checkout applies. The prices published at the time of purchase apply.
Add-ons. In addition to the plans, optional paid add-ons may be offered, currently:
- Tracking Pro — €5.99/month, for the Plus and Premium plans: unlimited tracking and link click tracking;
- Extra devices — €1.99/month for each additional device, for the Premium plan only, up to 10 additional devices. Increasing the number of devices is charged immediately, prorated for the remaining period; a reduction takes effect immediately on the number of usable devices and, with no further charge, on the amount from the next renewal.
Add-ons are billed monthly only, are Paddle subscriptions separate from the plan, are reserved for users with an eligible active paid plan, and can be deactivated at any time from the account area, effective at the end of the period already paid. If the paid plan ends or no longer allows the add-on, the add-on features cease to have effect and the Provider stops the automatic renewal of the add-on subscription; it can in any case be cancelled at any time from the account area. Add-on payments are subject to the same conditions as the plans (Paddle as authorized reseller, taxes, refunds).
In-app promotional suggestions. The application may occasionally display suggestions relating exclusively to Mailamber products and services (self-promotion): on theFree and Plus plans, the features of higher plans; onall plans, Premium included, the add-ons that can be purchased with the active plan and the other Mailamber apps (for example the Android or Windows app). The suggestion for an add-on does not appear once that add-on is active. These messages do not come from third-party advertisers, contain no third-party advertising, and are selected solely on the basis of the plan, the active add-ons and the types of device linked to your account — with no analysis of email content and no profiling (see theprivacy policy). The Premium plan shows no invitations to change plan.
5. Payments through Paddle
Purchases are concluded with Paddle.com Market Ltd («Paddle»), acting asmerchant of record: Paddle is the seller of record that collects payment, issues receipts and invoices and handles VAT. At the time of purchase,Paddle's checkout buyer terms also apply. The Provider remains solely responsible for the Mailamber service, its features and its support.
6. Term, renewal and cancellation
- Plus and Premium subscriptions run monthly or yearly andrenew automatically at the end of each period, at the price in force at renewal time.
- Before every plan renewal you receive an email reminder (7 days before forannual subscriptions, 3 days before for monthly ones); for every plan, the amount, cycle and next charge date are always available in your account area.
- You can cancel at any time, on your own, from the account area: the plan stays active until the end of the period already paid for, with no further charges, after which the account automatically moves to the Free plan.
- Cancelling never causes data loss: your emails remain on your device and stay accessible on the Free plan.
7. Plan changes and failed payments
- Changing plan or billing cycle happens with automatic proration: on upgrade only the difference for the remaining period is charged; on downgrade the new plan starts at the end of the period already paid for.
- If a renewal payment fails (for instance an expired card), after any retry attempts the account automatically moves to the Free plan. No email is ever lost: your content stays on your device.
8. Right of withdrawal and refunds
If you are a consumer, you have the right to withdraw from the purchase within14 days of concluding the contract, without giving any reason, under Directive 2011/83/EU on consumer rights and, for Italian consumers, Articles 52 et seq. of the Consumer Code (Legislative Decree 206/2005). The period applies to each subscription — the plan and, separately, each add-on — and runs from its respective purchase; a new subscription taken out after a cancellation is a new contract, with a new 14-day period. Automatic renewals of the same subscription do not start a new period; refund requests on renewals are nevertheless reviewed case by case, in good faith. Refunds are handled by Paddle as merchant of record. The procedure, effects and legal exceptions are described in therefund policy, which forms an integral part of these Terms.
9. Software license (EULA)
The Mailamber application is licensed, not sold, under aproprietary license. Without prejudice to theEnd-user license agreement (EULA), which supplements these Terms, the following conditions apply in summary:
- a personal, non-exclusive, non-transferable and revocable license, valid for the number of devices included in the active plan (1 for Free, 2 for Plus, 5 for Premium, extendable on Premium with the Extra devices add-on);
- copying, modifying, distributing, reselling, sublicensing, decompiling orreverse engineering the software is prohibited, except to the extent mandatorily permitted by law (Articles 64-ter and 64-quater of Italian Law 633/1941);
- circumventing the protection, licence verification or integrity measures, using tampered copies to unlock paid features or exceed plan limits, and distributing modified versions are prohibited: this is a serious breach allowing the account to be suspended or terminated, as provided in the EULA;
- all intellectual property rights in the software, the Mailamber trademark and the related materials remain the exclusive property of the Provider;
- any preview or test versions, if ever distributed and marked as such, are provided for evaluation and may contain defects.
10. Acceptable use
Use of the service is permitted only in compliance with applicable international sanctions and export-control rules.
You must not use the service or the application to:
- carry out unlawful activities or infringe third-party rights;
- send bulk unsolicited communications (spam) or run deceptive campaigns;
- compromise, probe or circumvent the security or availability of the Provider's or third parties' systems, including license and device limits;
- resell the service or make it available to third parties without authorisation.
In case of serious or repeated violations the Provider may suspend or terminate the account, with a reasoned notice where possible, without prejudice to any refunds due by law.
10-bis. Processing of the data of tracked email recipients (Art. 28 GDPR)
When you use sent email tracking, you are the controller of the recipients' personal data and the Provider processes it on your behalf as a processor. This section is the contract required by Art. 28(3) of Regulation (EU) 2016/679 ("GDPR") and applies in addition to the rest of these Terms; for anything not covered here, theprivacy policy, section 10-ter, applies. If you use tracking for purely personal or household purposes, the Provider applies the same safeguards anyway.
- Subject matter and duration. Storing and classifying the data needed to show you the delivery, opens and clicks of the emails you choose to track, for as long as you use the feature and, for each item of data, within the retention periods set out below.
- Nature and purpose. Collecting the requests to the pixel and to tracked links, automatically classifying each event (counted open, automated system, automatic Apple Mail open, your own view, duplicate), storing it and making it available on your devices. Sole purpose: providing the feature to you. The data is not used for any other purpose, profiling or advertising, nor disclosed to third parties.
- Types of data and categories of data subjects. Data subjects: the recipients of tracked emails and anyone who opens a tracked email or clicks its links (for example someone who receives it forwarded). Data: addresses of the "To" and "Cc" recipients (never "Bcc"), subject, message identifier and sending mailbox; for each open or click, date and time, link, generic class of the program used, classification and a pseudonym of the IP address. Never the IP address in clear, the user-agent, the location, or the body or attachments of the email. No special categories of data are intended; avoid including any in the subject of the emails you track.
- Your instructions and obligations. Your documented instructions are these Terms and the way you use the feature: turning tracking on, choosing which emails to track, deleting your account. The Provider processes the data only on these instructions, unless required to do so by Union or Member State law (in which case it informs you beforehand, unless that law prohibits it), and informs you if it considers that an instruction infringes the GDPR or other data protection rules. It is up to you to identify the legal basis, inform the recipients and, where the applicable rules require it (for example for marketing communications or under the rules on the confidentiality of electronic communications), obtain their consent.
- Confidentiality. The persons authorised by the Provider to process the data are bound by confidentiality and access it only when needed to provide the service, for the support you request or for security.
- Security (Art. 32 GDPR). IP addresses pseudonymised with HMAC-SHA256 and a secret key that stays on the server; no IP address or user-agent in clear; traffic encrypted with TLS (1.2 or 1.3, with HSTS); data visible only from your authenticated account, while the Provider's administration tools show only aggregate counts; database not exposed to the Internet and accessed by the service with a role without administrator privileges; encrypted backups; servers in the European Union.
- Sub-processors. You give the Provider a general authorisation to engage sub-processors. For tracking, they are at present Hetzner Online GmbH (hosting of servers and backups, Germany) and Cloudflare, Inc. (off-site backup copy in the EU jurisdiction of Cloudflare R2, encrypted before upload and unreadable by Cloudflare); if you turn on tracking notifications in the Android app, also Google LLC (Firebase Cloud Messaging, delivery of push notifications with only the content needed to display them). The Provider informs you of any addition or replacement through the procedure in section 12, so that you can object, including by stopping using the feature or withdrawing, imposes on each sub-processor data protection obligations equivalent to those in this section, and remains liable for their performance.
- Assistance. Taking into account the nature of the processing and the information available to it, the Provider assists you in responding to data subjects' requests (for example extracting or deleting the data of a specific recipient, at your request to privacy@mailamber.app) and with the obligations under Articles 32 to 36 GDPR (security, breaches, data protection impact assessment and prior consultation). If a recipient contacts the Provider directly, the request is forwarded to you.
- Personal data breaches. The Provider notifies you of a personal data breach affecting the data processed on your behalf without undue delay after becoming aware of it, at your account email address, with the information under Art. 33(3) GDPR available at that time, supplemented as it becomes available.
- Deletion at the end. The data of each tracked email and of the related events is deleted automatically 12 months after the registration of the email or of the event. If you delete your account, all tracking data is deleted immediately, and from encrypted backups within 30 days, unless the law requires it to be kept. Before deleting your account you can obtain a copy through the data export in the account area.
- Information and audits. On request, the Provider makes available to you the information necessary to demonstrate compliance with this section and allows for audits and inspections by you or by an auditor mandated by you and bound by confidentiality, with reasonable notice and without compromising the security and confidentiality of other users' data.
- Transfers. Tracking data is processed in the European Union and is not transferred outside the European Economic Area, except for the minimal content of push notifications (subject, first recipient, domain of the clicked link) if you turn on tracking notifications in the Android app: Google may process it in the United States too, under the EU-US Data Privacy Framework and standard contractual clauses. Any other future transfer would take place only with the safeguards of Chapter V GDPR and after notice through the procedure in section 12.
11. Warranties and liability
- Consumers benefit from the warranties provided by law, including the legal guarantee of conformity for digital content and digital services under Directive (EU) 2019/770 and, in Italy, Articles 135-octies et seq. of the Consumer Code. Nothing in these Terms excludes or limits rights that the law grants consumers on a mandatory basis.
- The Provider undertakes to keep the online services reasonably available, without guaranteeing uninterrupted operation; thanks to the local-first architecture, the app's core use does not depend on the Provider's online services.
- To the extent permitted by law, the Provider's aggregate liability is limited to the amount paid by the user in the 12 months preceding the harmful event. This limitation does not apply in cases of wilful misconduct or gross negligence, for personal injury, or to consumers' mandatory rights.
- The Provider is not responsible for third-party email services (IMAP/SMTP and PEC providers) that the user connects to through the application.
11-bis. Artificial intelligence features
- AI features are optional and produce automatically generated proposals from third-party models, which may be inaccurate, incomplete or unsuitable for the specific case. They are not legal, tax, medical or other professional advice.
- The user reviews every proposal before using it: generated text only goes into a message if the user applies it and is only sent on the user's command. The user remains the author of the messages they send and is responsible for them, including towards recipients and third parties, in compliance with section 10 (Acceptable use).
- The Provider marks AI features and AI-generated content in the app and describes the features, model providers, limits and how to turn them off on the pageAI in Mailamber; data processing is governed by section 10 of the privacy policy. Models and providers may change over time for quality and reliability, without reducing the safeguards described there.
12. Changes to the service and these Terms
The Provider may evolve the service and update these Terms, the EULA and the Refund Policy only for legitimate reasons: new or changed features, compliance with the law or with decisions of the authorities, security, changes in technical suppliers or in the costs of the service. Every material update follows this procedure:
- Notice. We inform you by email at your account address and with a notice in the account area and in the apps, with a summary of the changes and a link to the full texts; every published version states the date of its last update.
- 30 days to decide. You have at least 30 days from the notice to read the changes. You can accept them straight away with the “I accept” button; until you accept, the previous Terms continue to apply to you.
- Acceptance by continued use. If you keep using Mailamber after the date stated in the notice (30 days from the notice), the changes are deemed accepted. Tacit acceptance is recorded only if you actually used the service after that date and did not state that you do not accept; if you do not use it, the notice will be shown to you again when you come back.
- Right to refuse and withdraw. If you do not accept the changes you can say so with “I do not accept” and, by the date stated in the notice, terminate the contractwithout penalties or costs: cancel your subscription and delete your account from the account area (with a data export), or write tosupport@mailamber.app. In that case the changes do not apply to you.
- Consumers. If you are a consumer and a change has a material negative impact on the paid service or on the financial terms, you may terminate free of charge within 30 days of the notice (or of the time the change takes effect, if later) and obtain a refund of the part of the price already paid for the period after termination, in addition to the mandatory rights granted by consumer protection law. Price increases never apply to the period already paid and only take effect from the first renewal after the notice period expires.
Changes have no retroactive effect on periods already paid for. Purely formal changes, or changes required with immediate effect by a law or an authority, may apply without the 30-day notice, but you will still be notified. The Privacy Policy is not part of the contract: its updates are notified to you in the same way but do not require acceptance.
13. Governing law, jurisdiction and disputes
These Terms are governed by Italian law, without prejudice to any more favourable mandatory provisions of the country where the consumer habitually resides.
For disputes with consumers, the courts of the consumer's place of residence or domicile have jurisdiction; in all other cases the courts of Santa Maria Capua Vetere (Caserta, Italy) have exclusive jurisdiction.
Consumers may also use out-of-court alternative dispute resolution (ADR) procedures under Directive 2013/11/EU, by contacting the competent ADR bodies. The European online dispute resolution (ODR) platform was discontinued on 20 July 2025 by Regulation (EU) 2024/3228 and is no longer available. Before any formal step, we encourage you to write to us: nearly every problem is solved with an email tosupport@mailamber.app.
